Terms of Service

These Terms of Service govern your use of the Bourgeois Partners platform (the "Platform"). By accessing or using the Platform, you agree to be bound by these terms.

1. Description of Service

The Platform is a software tool designed for digital marketing agencies and consultants. It provides:

• Unified dashboard for managing advertising campaigns across Google Ads, Meta Ads, and other platforms
• AI-powered performance analysis, reporting, and optimization recommendations
• Integration with Google Ads, Meta Ads, Google Analytics 4, Search Console, HubSpot CRM, and Shopify via authorized OAuth 2.0 connections
• Automated campaign optimization actions executed only upon explicit user approval
• AI-generated ad creative and campaign recommendations

2. Account Eligibility

The Platform is intended for use by businesses and professionals managing digital advertising accounts. You must be at least 18 years old and have the authority to bind the entity on whose behalf you are using the Platform.

3. Platform Integrations and Authorized Access

The Platform connects to third-party advertising and analytics services via OAuth 2.0 authorization. By connecting a platform account, you represent that you have the authority to grant access to the data in that account. You may revoke access at any time through your connected platform's settings or through the Platform's Settings page.

We access data from connected platforms solely to provide the services described in Section 1. We do not access data for purposes unrelated to the Platform's functionality.

4. Google Ads API Usage

The Platform uses the Google Ads API to provide campaign management and optimization services. Our use of the Google Ads API complies with the Google Ads API Terms and Conditions, including the Google API Services User Data Policy. Specifically:

• We request only the minimum scopes necessary to provide our services
• Google Ads data is used exclusively to display campaign performance, generate reports, and provide optimization recommendations within this Platform
• We do not sell, lease, or share Google Ads data with third parties
• Campaign changes (budget adjustments, bid changes, pausing/enabling) are executed only after explicit user approval through our approval queue
• Users may disconnect their Google Ads account at any time, which immediately revokes our API access

5. Meta Platform Usage

The Platform uses the Meta Marketing API and Graph API to access advertising data. Our use complies with Meta Platform Terms. Meta data is used exclusively for reporting and optimization within this Platform.

6. AI-Generated Content

The Platform uses AI (Anthropic Claude) to generate reports, analysis, ad copy, and optimization recommendations. AI-generated content is provided as suggestions and should be reviewed before use. We do not guarantee the accuracy of AI-generated analysis. Automated campaign actions recommended by AI are queued for your review and require explicit approval before execution.

7. Data Handling

Platform data is stored securely using encrypted databases with row-level security. We process advertising data to generate reports and recommendations. We do not use your data to train AI models. For full details, see our Privacy Policy.

8. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorized access to other users' accounts or data
• Use the Platform to violate any advertising platform's terms of service
• Reverse-engineer, decompile, or extract the Platform's source code
• Use the Platform to generate misleading or deceptive advertising content

9. Limitation of Liability

The Platform is provided "as is" without warranties of any kind. We are not liable for any losses resulting from reliance on AI-generated recommendations, actions taken on connected advertising platforms, or interruptions to third-party API services. Our total liability is limited to the fees paid for the Platform in the 12 months preceding any claim.

10. Account Termination

You may terminate your account at any time. Upon termination, all stored data including platform credentials, reports, and conversation history will be permanently deleted within 30 days. We may suspend or terminate accounts that violate these terms.

11. Changes to Terms

We may update these terms periodically. Continued use of the Platform after changes constitutes acceptance. Material changes will be communicated via the Platform interface.

12. Governing Law

These terms are governed by the laws of the State of California, United States.
